The common law in Canada is based on one thing, consent. There is conditional consent and non-consent. For example, you have every right to charge someone $50 000 for access to your health records. If you non-consent you better be able to back it up, but don’t worry, the law is on your side!
With this new Vaccine passport system in Ontario, it’s not a piece of legislation but simply a “directive from the CMO.” The mainstream media dresses this up as law, but it’s simply a suggestion from the Medical Officer. https://news.ontario.ca/en/release/1000750/ontario-makes-covid-19-vaccination-policies-mandatory-for-high-risk-settings (2nd paragraph) There is no mention of law or Legislation because it’s not a piece of legislation.
Nothing is mandatory in Canada, you don’t have to do anything against your will. The Charter of Rights is the supreme law in Canada, and even that only applies to government. See section 32 of the Charter, it is very clear, I couldn’t make it more clear. https://www.justice.gc.ca/eng/csj-sjc/rfc-dlc/ccrf-ccdl/check/art321.html
32.(1) This Charter applies:
- to the Parliament and the government of Canada in respect of all matters within the authority of Parliament including all matters relating to the Yukon Territory and the Northwest Territories; and
- to the legislature and government of each province in respect of all matters within the authority of the legislature of each province.
Government rules only apply to government, simple. This is backed up by 2 pieces of case law also, R vs Big M Drug Mart: https://scc-csc.lexum.com/scc-csc/scc-csc/en/item/43/index.do and R vs Dell.
Nothing beneath the Charter applies to the average Canadian acting in their private capacity. The police and government will assume you’re one of them if you signed up for government ID at some point in your life. You need to correct your status and disclose your non-consent. So far the everyday Canadian has consented to everything the government is doing. By not saying no, legally that means you are consenting.
This vaccine passport system is not only invalid, but it doesn’t apply to anyone. We have rights in Canada, and it’s time people learned what they are!
